Terms of Service

These Terms of Service ("Terms") are between you and Epitrite LLC, based in Sarasota, Florida, United States ("Epitrite," "we," or "us"), and govern your use of the Service. By creating an account or using Epitrite, you agree to these Terms. If you don't agree, don't use the Service.
1. What Epitrite Is
Epitrite provides content planning, recording workflows, lyric video editing, rendering, and supported publishing integrations for musicians and their teams. Feature availability, usage allowances, and export options depend on the plan and platform shown in the Service.
2. Your Account
- You must be at least 13 and meet any higher minimum age required where you live. If you are not old enough to enter a binding contract, a parent or legal guardian must agree and supervise your use. If acting for a manager, label, or other organization, you must have authority to bind it.
- You're responsible for keeping your login credentials secure.
- Each person may create, control, and use only one Epitrite account. Don't share accounts.
- Creating or using additional accounts is prohibited, including to receive extra Free-plan exports, trials, discounts, promotions, storage, project slots, or other usage allowances.
- If we determine that you control more than one account, we will designate one account to remain open and permanently delete all other accounts. Projects, uploaded media, rendered videos, templates, settings, and other data associated with the deleted accounts will be permanently lost and cannot be recovered.
- We can suspend or terminate accounts that violate these Terms.
3. Your Content and Music Rights
We never claim rights to your music.You retain your rights in your audio, video, images, lyrics, and projects. Other owners retain their rights in licensed assets, templates, software, and material you include. Using the Service does not create rights in someone else's music or guarantee that generated material is exclusive or copyrightable. By uploading content, you grant us a limited license to host, reproduce, process, render, and transmit it through our service providers as needed to provide the features you request, including publishing you authorize. This license ends when the content is deleted from our systems, subject to legally required retention and restricted backup rotation described in our Privacy Policy.
You agree not to upload content that:
- You don't have the rights to use (including copyrighted music you don't own or license)
- Is illegal, harmful, or violates anyone else's rights
- Contains malware or malicious code
- Violates any applicable law or regulation
You're solely responsible for ensuring you have the necessary rights and licenses for any music, lyrics, images, or video clips you use in your projects.
Epitrite does not supply music for your projects. You provide your own audio and must have the rights needed for your intended use. Images and video clips made available by Epitrite are supplied with permission for use in the Service and your exported projects, subject to any license or restrictions identified with the asset. Fonts, trademarks, and people depicted may involve additional rights. Do not resell assets as standalone files, and check applicable rights before commercial publication or advertising.
Drafts, connected accounts, and publishing
Content OS suggestions, transcriptions, translations, and other generated drafts can be inaccurate or similar to material generated for others. Review facts, rights, captions, timing, and suitability before approving or publishing. You control the connected accounts and must authorize their use. Third-party platform rules apply; delivery, reach, earnings, acceptance, and continuous integration availability are not guaranteed. Revoking a connection does not automatically remove posts already delivered to a platform.
If you use YouTube features, you also agree to the YouTube Terms of Service.
Copyright reports
Report suspected infringement to support@epitrite.com with the work involved, the exact location of the disputed material, your contact details, and your authority to act. We may restrict disputed material and terminate repeat infringers in appropriate circumstances.
4. Paid Plans and Billing
Epitrite offers free and paid plans. Web subscriptions are billed through Stripe. Subscriptions purchased in the iPhone app are billed by Apple through In-App Purchase.
- Prices are listed on our pricing page and may change with 30 days' notice
- A web-based 7-day Pro trial requires a payment method and creates a Pro subscription. Unless you cancel from Billing before the trial ends, Stripe charges the monthly or annual price shown at checkout and the subscription continues to renew automatically.
- Subscriptions renew automatically until you cancel
- The checkout identifies the amount, currency, billing interval, applicable tax, trial or introductory period, and subsequent recurring price before you authorize payment. An introductory offer applies only where expressly shown and eligibility conditions are met.
- You can cancel anytime from Epitrite billing settings or Apple subscription settings, depending on where you subscribed. The cancellation screen explains when billing and access end. Choosing Epitrite's immediate cancellation ends Pro access immediately; cancellation through another billing portal follows the effective date shown there.
- Refunds for web purchases: We offer a full refund within 7 days of initial purchase. After that window, subscription fees are non-refundable except where required by law. Contact support@epitrite.com to request a refund.
- Refunds for App Store purchases are handled by Apple and are subject to Apple's refund policies
- We don't store your payment card details; Stripe or Apple handles payment processing for its respective purchase channel
For web subscriptions, open Settings > Billing and use the subscription management controls to cancel future renewals. If you cannot access those controls, contact support for assistance. Deleting the app does not cancel a subscription. Statutory cancellation, withdrawal, refund, and other consumer rights remain available even if they provide more protection than our voluntary refund policy. We provide renewal, trial, or price-change notices when required by applicable law.
5. Acceptable Use
Don't use Epitrite to:
- Attempt to access other users' accounts or data
- Create, control, or use more than one account
- Reverse-engineer, scrape, or abuse the Service
- Overload our systems (automated bulk requests, bots, etc.)
- Circumvent usage limits or billing restrictions
- Use the Service for anything illegal
6. Service Availability
We aim to keep Epitrite running smoothly, but we can't guarantee 100% uptime. The Service is provided "as is" to the extent permitted by law. We may perform maintenance, updates, or changes that temporarily affect availability.
7. Limitation of Liability
To the maximum extent permitted by law, Epitrite and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or content. Our total liability for any claim is limited to the amount you've paid us in the 12 months before the claim.
These exclusions and limits do not restrict liability or consumer guarantees that cannot lawfully be excluded, including liability for fraud or other conduct for which applicable law prohibits a limitation. Keep copies of source material and important exports.
8. Termination
- You can delete your account at any time
- We can suspend or terminate your account for violating these Terms
- When we enforce the one-account-per-person rule, access to the duplicate accounts ends and their associated data is permanently deleted. Epitrite is not responsible for preserving or recovering data from a duplicate account; deleted data cannot be restored.
- Upon termination, your data will be deleted within 30 days (except as required by law or to resolve disputes)
9. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we'll notify you via email or a notice in the app. Continued use after changes means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles, subject to mandatory rights under the law where you live. Subject to the arbitration provision below, courts with jurisdiction in Sarasota County, Florida, are the agreed forum unless applicable consumer law gives you a different forum that cannot be waived.
11. Arbitration and Class Action Waiver
To the extent enforceable under applicable law, disputes arising out of these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to participate in any class action, collective action, or representative proceeding against Epitrite. Small claims court actions and claims for injunctive relief to protect intellectual property rights are excluded from this arbitration requirement. You may opt out of this arbitration agreement by emailing support@epitrite.com within 30 days of first accepting these Terms. This provision does not waive rights, remedies, public injunctive relief, or access to regulators that cannot lawfully be waived. If arbitration or the waiver cannot legally apply to a dispute, that dispute may proceed in a competent court under Section 10.
